Terms of Service
These terms govern your access to and use of CheckBeacon. Please read them carefully.
This page is general boilerplate provided for informational purposes and does not constitute legal advice. Before relying on these terms for a production business, you should have them reviewed by a qualified attorney.
1. Acceptance of terms
By creating an account, accessing, or using CheckBeacon (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of service
CheckBeacon provides uptime, latency, and user-journey monitoring for APIs and web applications, including scheduled API/HTTP checks, browser-based UI checks, multi-step checks, multi-region execution, results history, and alerting. CheckBeacon is also available as self-hosted software under a separate license for that software; these Terms primarily apply to our hosted ("cloud") offering.
3. Accounts & responsibilities
- You are responsible for maintaining the confidentiality of your account credentials and API tokens.
- You are responsible for all activity that occurs under your account, including checks you configure and any data you submit.
- You must provide accurate information when creating an account and keep it up to date.
- You are responsible for ensuring you have the right to configure checks against the URLs and endpoints you monitor.
4. Acceptable use
You agree not to use CheckBeacon to:
- Configure checks against systems you do not own or do not have permission to monitor.
- Use the Service to conduct denial-of-service attacks, excessive scanning, or other abusive traffic patterns.
- Attempt to gain unauthorized access to CheckBeacon's systems or other customers' data.
- Use the Service to store or transmit unlawful, infringing, or malicious content.
- Reverse engineer or attempt to circumvent rate limits, plan limits, or security controls of the Service.
5. Subscriptions & billing
- Paid plans are billed in advance on a recurring basis (monthly or annually) as described at the time of purchase.
- Plan limits (number of monitors, check frequency, regions, retention, and seats) are described on our Pricing page and may change with notice.
- Fees are non-refundable except as required by law or as we expressly state otherwise.
- You can downgrade, upgrade, or cancel a subscription at any time; changes take effect according to the billing terms presented at checkout.
6. Intellectual property
CheckBeacon and its original content, features, branding, and functionality are owned by CheckBeacon, Inc. and are protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes. You retain all rights to the data and configurations you submit to the Service.
7. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that monitoring checks will detect every issue with your systems.
8. Limitation of liability
To the maximum extent permitted by law, CheckBeacon, Inc. and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business arising from your use of, or inability to use, the Service. Our total liability for any claim arising out of these Terms or the Service will not exceed the amount you paid us in the 12 months preceding the claim.
9. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, fail to pay applicable fees, or if we discontinue the Service, with notice where reasonably practicable. Upon termination, your right to use the Service will cease, and we will handle your data in accordance with our Privacy Policy.
10. Changes to terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date on this page and, where appropriate, notify account owners by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which CheckBeacon, Inc. is incorporated, without regard to conflict-of-law principles, except where applicable local law requires otherwise.
